The key to dealing with extreme heat is to stay hydrated and slow down.  What better excuse is needed to grab an ice cold drink and settle back with the latest edition of ATEMatters from Legal Protection Group.

We start this month with a recent high profile Clinical Negligence case centred on consent to deduct unrecoverable costs from damages.  Next up is an unusual one and not one we would normally include however the background to the case and the resulting impact on a ‘strike out’ application make it worth bringing to your attention.  Refusal to mediate and the impact on costs brings us back on track followed by a really key case judgment involving ATE insurance, litigation funding and ultimate costs liability.  Well worth taking note of!  Finally this edition, we bring to your attention the CJC’s establishment of a costs working group which has invited responses to its recently published consultation paper.  A link is included for you to access all the relevant details.
